Welcome to evolvechannelmark. By accessing our website at evolvechannelmark.com and using our budget prioritization services, you're agreeing to these terms. We've written this in plain language because legal documents don't need to be impossible to understand.

1. Acceptance and Scope

These terms govern your relationship with evolvechannelmark. When you use our website, sign up for our services, or communicate with us through any channel, you're bound by what's written here.

We update these terms occasionally to reflect changes in how we work or Australian legal requirements. The date at the top tells you when we last made changes. We'll try to notify active users about significant updates, but it's worth checking back now and then.

2. Services We Provide

We help businesses and individuals in Australia make smarter decisions about their money through budget prioritization tools and advisory services. What we don't do is guarantee specific financial outcomes.

Important: Our services provide guidance based on your financial information and goals. The actual results depend on countless factors outside our control — market conditions, personal discipline, unexpected expenses, and economic shifts to name a few. We're here to help you organize and prioritize, not to promise miracles.

Our platform includes digital tools for budget tracking, educational resources about financial planning, and one-on-one consultations when appropriate. Each service has its own specific terms that we'll share before you sign up.

3. Your Account Responsibilities

When you create an account with us, you're responsible for keeping your login information secure. That means choosing a decent password and not sharing it with others.

What You Promise Us

  • The information you provide is accurate and up-to-date
  • You're legally able to enter into agreements in Australia
  • You won't use our services for anything illegal or harmful
  • You'll notify us immediately if someone else accesses your account
  • You won't try to reverse-engineer or copy our platform

If we discover that an account is being misused or contains false information, we reserve the right to suspend or terminate it. We'll usually reach out first to understand what's happening, but serious violations might result in immediate action.

4. Payment Terms

Payments are processed in Australian dollars through secure payment providers. When you subscribe to a paid service, you authorize us to charge your payment method automatically until you cancel.

Refunds and Cancellations

You can cancel most subscriptions at any time, and you'll continue to have access until the end of your current billing period. We don't typically offer refunds for partial months, but we'll work with you if there's been an error on our end or unusual circumstances.

For one-time consultations or services, cancellations must be made at least 48 hours in advance for a full refund. Later cancellations may incur a fee to cover preparation time.

5. Intellectual Property

Everything on our platform — the code, design, content, tools, and educational materials — belongs to us or our licensors. You're welcome to use it for your personal financial planning, but you can't reproduce, distribute, or sell any of it.

The budget templates and strategies you create using our tools are yours. We don't claim ownership of your financial data or planning documents.

6. Privacy and Data Usage

We take your financial information seriously. Our separate Privacy Policy explains exactly what data we collect, how we use it, and who we share it with (spoiler: very few people, and only when necessary).

Under Australian privacy laws, you have specific rights regarding your personal information. You can request to see what we have, ask us to correct it, or request deletion in most cases.

We won't sell your financial data to third parties. That's not how we operate, and it never will be.

7. Limitations and Disclaimers

Here's the part every service needs to include — the limitations on what we can be held responsible for.

Service Availability

We work hard to keep our platform running smoothly, but technology isn't perfect. Sometimes things break, need maintenance, or experience unexpected issues. We're not liable for temporary outages or data loss, though we do maintain regular backups.

Financial Advice Disclaimer

Our services provide educational information and organizational tools. We're not licensed financial advisors, and nothing we provide should be interpreted as personalized financial advice for investment, tax, or legal purposes. For those matters, consult appropriate licensed professionals.

  • You're responsible for your own financial decisions

8. User Conduct

We expect users to treat our platform, team, and other users with respect. Specifically, you agree not to:

  • Harass our team members or other users
  • Create fake accounts or impersonate others
  • Use our services to promote scams or illegal activities
  • Scrape or extract data through automated means
  • Share your account access with unauthorized users

Violations of these conduct rules may result in immediate account termination without refund.

We carefully select partners who meet our standards for security and reliability, but we can't control their services completely. Issues with third-party providers are outside our direct responsibility, though we'll help where we can.

10. Termination

Either party can end this relationship. You can close your account at any time through your account settings. We can terminate accounts that violate these terms or for other legitimate business reasons.

When an account is closed, you'll lose access to our platform and any data stored there. We recommend exporting your financial information before closing your account. We retain some information for legal and accounting purposes as required by Australian law.

11. Dispute Resolution

If something goes wrong, let's talk first. Contact us directly, and we'll work in good faith to resolve the issue. Most problems can be sorted out through honest conversation.

For disputes that can't be resolved through discussion, these terms are governed by the laws of Queensland, Australia. Any legal proceedings must be brought in the courts of Queensland. We both agree to first attempt mediation through an agreed-upon third party before pursuing litigation.

12. Changes to Services

We're constantly improving our platform and may add, modify, or discontinue features over time. We'll generally notify users of significant changes, especially those affecting paid services.

If we make changes that substantially reduce functionality you've paid for, we'll offer appropriate remedies, which might include prorated refunds or alternative features.

13. Limitation of Liability

To the maximum extent permitted by Australian consumer law, our liability to you is limited to the amount you've paid us in the six months before the issue arose, or 0 AUD, whichever is greater.

We're not liable for indirect, consequential, or punitive damages arising from your use of our services. This includes lost profits, data loss, or business interruption.

Australian Consumer Law: Nothing in these terms excludes or limits rights under the Australian Consumer Law that cannot be excluded or limited. Where we're liable for a breach of consumer guarantees, our liability is limited to resupplying the services or paying for their resupply.

14. General Provisions

If any part of these terms is found to be unenforceable, the rest remains in effect. Our failure to enforce any right doesn't waive that right for future situations.

These terms represent the entire agreement between you and evolvechannelmark regarding our services. They replace any previous agreements or understandings.

You can't transfer your rights under these terms to anyone else. We can transfer our rights and obligations to another entity as part of a business restructure or sale, provided your rights aren't materially affected.
